This Policy explains how PenHuman collects, uses, and protects your information when you use our generation, humanization, and AI detection features.

1. Scope & Overview

This Privacy Policy explains how PenHuman ("PenHuman", "we", "us", or "our") collects, uses, shares, and protects information when you use our websites, applications, browser extensions, APIs, and other online products and services (collectively, the "Services").

This Policy applies to visitors to our websites, registered users of PenHuman, and users of any associated apps, extensions, or APIs. It does not apply to information processed outside of PenHuman or to third-party services that may be linked from our platform.

By accessing or using the Services, you agree to this Privacy Policy. If you do not agree, you should not use the Services.

2. Information We Collect

2.1 Information You Provide

  • Account Information: name, username, email address, password, and other profile details you choose to provide.
  • Content and Usage Inputs: text, documents, prompts, and files you submit for generation, rewriting, humanization, or AI detection, as well as associated settings and preferences.
  • Subscription and Billing Information: plan type, subscription status, and limited billing details (such as transaction IDs and card brand/last4) received via our payment processor. Full payment card data is handled by third-party processors and is not stored on PenHuman systems.
  • Communications: messages, support requests, feedback, bug reports, and any attachments or media you send to us.
  • Community or Public Content (if available): posts, comments, and other content you share in community or public areas of the Services.

2.2 Information Collected Automatically

When you access or use PenHuman, we automatically collect certain technical and usage information, such as:

  • Device and browser type, operating system, language, and time zone.
  • IP address and approximate location (for example, city or region-level information).
  • Referring and exit pages, URLs visited, and clickstream data.
  • Date and time of access, session duration, and interaction with features and pages.
  • Performance, diagnostics, and log data, including error reports, response times, and resource usage.

2.3 Cookies and Similar Technologies

We use cookies, local storage, and similar technologies to keep you signed in, remember your preferences, measure performance, secure the Services, and support analytics and (where applicable) marketing features. You can usually control cookies through your browser settings, but disabling certain cookies may affect the functionality of the Services.

2.4 Information from Third Parties

  • Authentication providers: if you sign in using a third-party login, we may receive basic profile details (such as name, email, and avatar) from that provider.
  • Integration partners: when you connect PenHuman to another tool (such as a storage or productivity app), we may receive access tokens and related information necessary to provide the integration.
  • Public sources: where permitted by law, we may use limited publicly available information to maintain security, detect abuse, or improve user experience.

3. How We Use Information

We use the information we collect for the following purposes, in each case in accordance with applicable law:

  • To operate, maintain, and improve the Services and core features.
  • To process your prompts, documents, and settings for generation, humanization, and AI detection.
  • To provide account management, subscriptions, billing, and customer support.
  • To monitor performance, analyze usage patterns, and develop new features and products.
  • To prevent fraud, abuse, and security incidents, and to debug technical issues.
  • To personalize aspects of your experience where appropriate and permitted.
  • To comply with legal and regulatory obligations and enforce our terms and policies.

We do not sell your personal information. We use it to provide and improve PenHuman and to maintain a secure, reliable service.

4. AI-Generated Content, Humanizer & Detector Accuracy

PenHuman uses machine learning models to generate, rewrite, humanize, and analyze text, and to detect whether content may be AI-generated. These systems are probabilistic and have inherent limitations.

  • No humanizer or detector is 100% accurate, and outputs may still appear AI-generated, unnatural, or unsuitable in specific contexts.
  • Detection tools can produce false positives (flagging human content as AI) and false negatives (missing AI-generated content).
  • Outputs may contain errors, omissions, bias, or outdated information, even where they sound confident or authoritative.

You must exercise your own judgment and due diligence before relying on any output, especially for academic, professional, legal, medical, financial, or other high-impact uses. PenHuman aims to deliver high-quality results and continuously improve accuracy, but no outcome or level of performance is guaranteed.

5. Academic Integrity & User Responsibility

PenHuman is designed to assist with learning, drafting, editing, and analysis—not to replace your own work where that would be inappropriate or prohibited.

  • You are responsible for complying with all applicable academic integrity, plagiarism, and conduct rules set by your school, institution, or organization.
  • You agree not to use PenHuman to cheat on exams, assignments, or assessments, or to engage in any form of academic or professional misconduct.
  • You are solely responsible for how you edit, use, submit, or present any content produced, rewritten, or analyzed using PenHuman.

PenHuman does not control how you choose to represent content to third parties and does not accept responsibility for any academic, professional, or disciplinary consequences arising from your use of the Services.

6. Limitation of Liability, No Warranty & Indemnification

To the fullest extent permitted by law, PenHuman and its developers, partners, and affiliates are not liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to your use of or inability to use the Services.

All content generated, rewritten, transformed, or analyzed by PenHuman is provided on an "as is" and "as available" basis and without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or non-infringement.

Content Accuracy

The Services may produce errors, inaccuracies, or outputs that do not meet your expectations. PenHuman does not guarantee the accuracy, reliability, completeness, or suitability of any generated, rewritten, or analyzed content.

User Responsibility

You are solely responsible for reviewing, verifying, and editing all outputs before use. Any decisions or actions taken based on content produced by PenHuman are taken at your own risk.

No Professional Advice

Content from the Services is for informational and assistive purposes only and should not be treated as legal, financial, medical, professional, or expert advice. You should consult qualified professionals before relying on any content for such purposes.

Third-Party Interpretation

PenHuman is not responsible for how third parties—including AI detection tools, plagiarism scanners, platforms, institutions, employers, or other organizations—interpret, score, or evaluate content produced using the Services.

Service Availability

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Maintenance, upgrades, network issues, and other factors may cause downtime or errors.

Indemnification

By using PenHuman, you agree to indemnify, defend, and hold harmless PenHuman and its developers, partners, and affiliates from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use or misuse of the Services, your violation of this Policy or applicable law, or your infringement of any third-party rights.

Nothing in this Policy is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

7. Legal Bases for Processing

In jurisdictions where data protection laws require a legal basis for processing personal data (such as the European Economic Area or United Kingdom), PenHuman relies on one or more of the following legal bases:

  • Performance of a contract: to provide the Services you request, manage your account, and process your subscription.
  • Legitimate interests: to operate, secure, and improve the Services; prevent fraud and abuse; and communicate with you, where our interests are not overridden by your rights.
  • Consent: where required by law, for example for certain cookies or marketing communications. You may withdraw consent at any time.
  • Legal obligation: to comply with applicable laws, regulations, and legal processes.
  • Vital interests: in rare cases, to protect your vital interests or those of others.

8. Sharing & Disclosures

We may share information in limited circumstances, with safeguards in place, as described below:

  • Service providers: infrastructure and hosting, payment processing, analytics, logging, email and messaging, and customer support providers that process data on our behalf under appropriate agreements.
  • AI and technology partners: model and infrastructure providers that enable AI functionality, subject to contractual limits on how data may be used.
  • Integration partners: when you connect PenHuman to another tool, we share data as needed to provide that integration according to your settings.
  • Business transfers: in connection with a merger, acquisition, reorganization, or similar transaction, information may be transferred as part of our business assets.
  • Legal and safety: where necessary to comply with laws, respond to valid legal requests, enforce our terms, or protect rights, property, or safety.
  • Aggregated or de-identified data: information that cannot reasonably be used to identify you may be shared for research, analytics, or other purposes.

We do not sell your personal information.

9. Data Retention & Cancellation

We retain personal information for as long as necessary to provide the Services, fulfill the purposes described in this Policy, comply with legal and regulatory requirements, resolve disputes, and enforce our agreements.

Retention periods may vary depending on the type and context of the data. When information is no longer required for these purposes, we will delete it or anonymize it in a secure manner.

If you have a paid subscription and you cancel it, the cancellation will take effect at the end of your current billing period (the next renewal date). Until that renewal date:

  • You will continue to have access to the paid features tied to your subscription.
  • We will continue to process your information in connection with those features, as described in this Policy.

After the cancellation takes effect, we will stop renewing your subscription and will not bill you for future periods. We may continue to retain and process information as necessary for the purposes described above, including compliance, security, and legitimate business needs.

10. Security

We implement reasonable technical and organizational measures designed to protect information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

  • Use of encryption in transit (such as HTTPS) where appropriate.
  • Access controls, authentication, and least-privilege principles for internal systems.
  • Logging and monitoring to detect unusual activity.
  • Internal policies and training aimed at protecting user data.

No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You are encouraged to use strong, unique passwords and to safeguard your account credentials.

11. International Transfers

Information we collect may be stored and processed in countries other than the country where you reside. These countries may have different data protection laws.

Where required by law, we implement appropriate safeguards for international data transfers, such as standard contractual clauses or similar mechanisms, to help ensure that your personal information remains protected.

12. Your Rights & Choices

Depending on your jurisdiction, you may have some or all of the following rights with respect to your personal information:

  • Right to request access to the personal data we hold about you.
  • Right to request correction of inaccurate or incomplete information.
  • Right to request deletion of your personal information, subject to certain legal exceptions or obligations.
  • Right to request restriction of processing in certain circumstances.
  • Right to request a structured, commonly used, and machine-readable copy of certain information (portability).
  • Right to object to certain processing, including direct marketing, based on our legitimate interests.
  • Where processing is based on consent, right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

You may also be able to update certain account information directly in your account settings (where available) and manage your marketing preferences via unsubscribe links or in-message settings.

If you believe your data protection rights have been violated, you may have the right to lodge a complaint with a data protection authority in your jurisdiction.

13. Children & Minors

The Services are intended for adults. By using PenHuman, you represent that you are at least 18 years old or the age of majority in your jurisdiction, whichever is higher.

We do not knowingly collect personal information from children under 18. If we become aware that a child has provided personal information in violation of this Policy, we will take reasonable steps to delete such information.

If you believe that a child has provided personal information to PenHuman, you should notify us through the support or contact options available within the Services.

14. Third-Party Websites & Services

The Services may contain links to, or integrations with, third-party websites, applications, or services. These third parties are independent of PenHuman and have their own privacy policies and practices.

We are not responsible for the content, privacy practices, or security of third-party services. You should review the privacy policies of any third-party services you use in connection with PenHuman.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors.

When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice (for example, via in-service notifications). Your continued use of the Services after any changes become effective constitutes your acceptance of the updated Policy.
